Welcome to Sesame Seed Learning, LLC ("Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website https://www.sesameseedlearning.com ("Website") and the live, online classes we provide ("Services").
By accessing or using our Website or Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Services
We provide live, online educational classes conducted over Zoom. Class details, schedules, and prices are listed on our Website and may change without prior notice. Courses are solely intended for the personal educational benefit of the participants. No accreditation or transferable credit of any course is given or implied.
2. Eligibility
You must be at least 18 years old to register for our Services, and reside in a country that is not subject to US sanctions nor be an individual listed on the US sanctions list. If you are the parent or legal guardian of a child under 18 years of age, you are granting your permission for your child to participate and are registering in their behalf and are agreeing to these terms and conditions yourself and are responsible for their adherence to these terms and conditions as well. Children under age 13 years are not permitted to enroll in any course at this time.
3. Registration and Accounts
You agree to provide accurate, complete, and up-to-date information when registering. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device.
4. Payment, Refund, and Cancellation Policy
Payment must be made at the time of registration.
All fees for courses and/or classes are non-refundable unless otherwise specified in writing. This policy encourages students to continue with a course to its completion. We reserve the right to cancel classes due to unforeseen circumstances. In the event that a class is canceled by Sesame Seed Learning, LLC due to unforeseen circumstances, participants will be offered the choice of a full refund or the option to attend a rescheduled class.
Participants may request a cancellation and refund within 48 hours of registration, provided the request is made no less than 72 hours before the scheduled class start time. Participants are responsible for any local taxes or financial charges associated with international payments.
5. Class Conduct
By joining our classes, you agree to behave respectfully toward instructors and other participants. In our sole and absolute discretion we reserve the right to remove any participant who disrupts the class without a refund. Classes will be open to both male and female students and to students from many countries, without segregation. Absolute respect for all other students is mandatory. If minors engage in any form of misconduct, misbehavior, or the display of inappropriate content, their responsible parent/legal guardian will be notified. If deemed sufficiently serious in nature, parents/legal guardians of other students in attendance will be notified as well. All conduct between students and instructors will reflect the highest of behavioral standards. All classes may be moderated or recorded for accountability purposes. If recordings for accountability purposes are made, they will not be provided to any third-party for marketing or any marketing-related purposes.
6. Personal Responsibility for Safety
You are responsible for your own safety as it pertains to other members of the class. You agree to assume full responsibility for your own actions during and after the class. We do not encourage the sharing of personal contact information with other class participants. Classes will involve break-out sessions of students in smaller groups with each other. We will not be monitoring these sessions. It is your sole responsibility to ensure you are comfortable with the conduct of other participants. If you ever feel uncomfortable in any way during one of the class sessions, exit the class immediately by closing your browser and/or Zoom connection and report the situation by emailing: safety@sesameseedlearning.com
7. Intellectual Property
All materials provided in the classes, including recordings (if applicable), handouts, and content, are owned by Sesame Seed Learning, LLC or its licensors. You may not copy, distribute, or reproduce any content without written permission. Any user of the Sesame Seed Learning homepage (https://www.sesameseedlearning.com) or any of its child pages agrees not to copy, modify, alter, attempt to alter, or attempt to gain unauthorized access to any material from any of these pages by any means regardless of their copyright status. By accessing these pages you agree to this policy.
8. Technology Requirements
Participants must have access to a stable internet connection, a compatible device, and a Zoom account. We are not responsible for technical issues on the participant’s end. Zoom provides requirements and suggested requirements to have a good connection. These include having an internet connection with at least 3.8Mbps upload speed and 3.0 Mbps download speed. It is also suggested to have downloaded the Zoom software on a desktop/laptop or the Zoom app for a phone (as opposed to merely connecting to Zoom via a browser). Downloading and using the 64-bit version (on a 64-bit computer/device) of Zoom is highly recommended as is quitting all other applications during its use. These recommendations and requirements are necessary to reduce overall lag time which will be present to some extent regardless. 9. Limitation of Liability
Our Services are provided on an "as is with all faults" basis. To the maximum extent permitted by law, Sesame Seed Learning, LLC disclaims all warranties including without limitation all express or implied warranties, and will not be liable for any indirect, incidental, punitive, or consequential damages arising out of your use of our Services. Under no circumstances will liability be deemed to be more than the amount paid for the class/course.
10. Waiver of Liability
By participating in our online classes, you acknowledge and agree that Sesame Seed Learning, LLC, its owners, officers, directors, employees, contractors, agents, instructors, and affiliates are not responsible for any injury, loss, or damage resulting from, related to, or in connection with your participation. You indemnify, defend, release and hold harmless Sesame Seed Learning, LLC, its owners, officers, directors, employees, contractors, agents, instructors, and affiliates from any and all expenses, charges, liabilities, claims, demands, or causes of action except for burdens that are caused solely by Sesame Seed Learning, LLC’s gross negligence, willful and intentional misconduct, or knowing violation of law. Educational content is provided for informational purposes only and is not intended as professional, legal, financial, or medical advice.
11. Cultural Sensitivity and Compliance
Our Services are designed to be respectful and mindful of cultural, religious, and national sensitivities. However, participants are solely responsible for ensuring that their participation in our classes complies with all applicable local laws and cultural norms in their country. Sesame Seed Learning, LLC disclaims any liability arising from regulatory, cultural, or legal restrictions that may affect your access to, or use of, our Services. We are not responsible for the actions of any participant.

13. Children’s Privacy (Under Age 18) and Parent/Legal Guardian Consent for Minor Students

14. Changes to Policies and Procedures in the Student Agreement
We may update the policies and procedures in the Student Agreement at our sole discretion from time to time. Changes will be posted on that page with an updated "Last Updated" date, and you may be sent notification of such updates.
15. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Participants submit to the exclusive personal jurisdiction of the federal and state courts in the State of Utah. The exclusive venue for any dispute arising hereunder shall be the federal and state courts located in the State of Utah, County of Utah and the participant hereby submits to the personal jurisdiction of such courts. The prevailing party in a dispute will have their legal fees reimbursed. These terms and conditions along with those specified in the Privacy Policy and the Student Agreement constitute the entirety of the agreement between all parties, and are not modified by any external communications, emails, or contracts.
